By this application, the appellant and the legal heirs of the respondent who are related to each other have brought on record the compromise arrived at between them. As per the said compromise, the parties have agreed to receive certain properties as mentioned in Schedule A & B of the plaint as their properties in lieu of their respective shares. Along with the application, affidavit has been filed by the appellant as well as one of the legal heirs of the deceased respondent.

Considering the aforesaid documents along with the relinquishment deed filed on record, the application is allowed. The judgment dated 18-9-2010 passed in Regular

2 2760cas614.17 Civil Appeal No.330/2006 is partly modified in terms of the compromise petition. Second Appeal is disposed of in aforesaid terms. Decree be drawn accordingly. Civil application is also allowed in aforesaid terms with no order as to costs.
