By these Applications, the applicant seeks condonation of delay in filing the Application for substituting the names of the legal heirs of deceased-respondent no.3, on record, for setting aside the abatement, if any, and for permission to bring the legal heirs of deceased respondent no.3, on record.

Since this is a Writ Petition, the provisions of the Code of Civil Procedure may not be strictly applicable.

For the reasons stated in the Applications for condonation of delay and setting aside abatement, we condone the delay and set aside the

13.07.caw.1403.16+ abatement, if any. The applicant-petitioner is permitted to substitute the names of the legal heirs of deceased-respondent no.3, on record.

Civil Applications are allowed and disposed of. The amendment should be carried out within two weeks.
