The complaint was filed under Section 138 of the Negotiable Instruments Act, 1881. The impugned order pertains to the dismissal of the complaint on the ground that the complainant and their advocate remained absent for the last 4-5 dates, no verification was carried out, and hence, there were no sufficient grounds to proceed with the case. 2.

Even in the present appeal, none appears for the appellant. The matter was admitted by an order dated 09/07/2014. Today, neither the appellant nor the respondent is present. It appears that the appellant has lost interest in prosecuting the appeal.
