Today also when the matter is called out, none appears for the appellant. The decree is for possession on the basis of title. The appeal has been dismissed. The original defendant is before this Court against the concurrent findings of fact. The ownership of the plaintiff is not disputed. The agreement to sale (Visar Pavati) at Exhibit 79 was putforth by the defendant. In para 20 of its judgment and order, the lower Appellate Court has rejected the claim for possession on the basis of Visar Pavati. No substantial question of law arises. The second appeal
