CORAM : B. P. DHARMADHIKARI AND Z.A. HAQ, JJ.
DATE : JUNE 27, 2018.
Heard Ms. Rashi Deshpande, learned Counsel for the petitioner.
2.
Petitioner is promoted and transferred to Gondia. It appears that this order was issued to him in the year 2015. Thereafter he has continued at Nagpur only till receipt of order dated 27.03.2018. By that order, he has been asked to get himself relieved and report on the promotional post. He has been warned that in default candidature of next junior would be considered for promotion.
3.
Against this order the petitioner has
Order 2706wp3613.18 approached Central Administrative Tribunal in Original Application No. 407/2018. The Central Administrative Tribunal has vide order dated 08.06.2018, dismissed the said Original Application. 4.
Grievance of petitioner is, he being Trade Union leader is being victimized and there is no administrative exigencies.
5.
We have perused the orders passed by the Central Administrative Tribunal.
The Central Administrative Tribunal has found that the petitioner had option to report at Gondia on promotional post, if he so desired. It is also observed that he may make a representation for cancellation/modification etc., of earlier order sending him to Gondia dated 26.06.2015. It has however found no legal right in him to maintain the Original Application.
6.
We also do not see any such right in the petitioner. There is no jurisdictional error or perversity. Writ Petition is, therefore, dismissed. No costs.
