Heard.
This is an application by respondent - claimant Nos. 1 to 6 for withdrawal of the amount of compensation which was deposited by the appellant in this Court. It is submitted that First Appeal No. 186 of 2007 has already been decided by this Court vide judgment and order dated 25.07.2018.
The learned counsel for the appellant has no objection if the present application is allowed. The learned counsel for non-applicants submits that non-applicant Nos. 7 & 8 are in-laws of non-applicant No. 1 (parents of the deceased Bhavarilal) and they are reported to be dead. It is, further submitted that non-applicant Nos. 2 to 6 have
1311caf2537.19 executed a Power of Attorney authorizing nonapplicant No. 1 for withdrawal of amount on their behalf. (The original copy of the Power of Attorney is placed on record).
In this view of the matter, Civil Application is allowed and non-applicant No. 1 is permitted to withdraw the amount of compensation for herself and on behalf of non-applicant Nos. 2 to 6 with accrued interest, if any.
Civil application is accordingly disposed of in terms of prayer clause in the application. However, there shall be no order as to costs. JUDGE *GS.
