This is an application for condonation of delay in filing the appeal. The delay is of 73 days. For the reasons stated in the application, it is allowed. The delay is condoned.
Criminal Application No.450/2015 is disposed of accordingly.
Criminal Appeal No. /2015 Heard Mr. Doifode, learned A.P.P. for the appellant-State.
The respondent is acquitted by the learned Special Judge, Chandrapur on 22.01.2015 in Special Case No.18/2013 of the offence punishable under Sections 456, 354, 448 of the Indian Penal Code and under Sections 7, 8 and 9 (m) of the Protection of Children From Sexual Offcences Act, 2012. The prosecutrix and her father Gurudas are the relevant witnesses. With the assistance of learned A.P.P., I have gone through the evidence of these two
appa450.15 witnesses. According to me, the learned trial Judge has correctly evaluated their evidence and has rightly come to the conclusion that the prosecution has failed to prove the guilt of the respondent beyond reasonable doubt.
In that view of the matter, no interference is required in the impugned order. The appeal is, therefore, dismissed.
