The learned counsel for the parties state that the facts and the issue involved in this case are similar to the facts and the issue involved in Writ Petition No.3904 of 2016 and this Court has, by the judgment dated 22.12.2016, allowed the said writ petition and has granted a similar declaration as sought by the petitioner in the instant petition. In view of the aforesaid and for the reasons recorded in the judgment, dated 22.12.2016 in Writ Petition No.3904 of 2016, we allow this writ petition. It is hereby declared that the reservation of the land of the petitioner admeasuring 1.00 Hectares in Pusad Khand-2 for playground as per the final development plan, dated 26.07.1998 has lapsed and the petitioner is free to develop the land as is permissible in the case of adjacent land, under the relevant development plan.

Order accordingly. No costs.
