Order dated 18.08.2016 passed by this Court was assailed by the State before the Hon'ble Apex Court by filing Criminal Appeal No.1580/2017 and the Hon'ble Apex Court, vide judgment dated 07.09.2017, not only allowed the appeal filed by the State but also dismissed the present criminal application.

In that view of the matter, the application is disposed of in terms of the judgment of the Hon'ble Apex Court.
