DATED : NOVEMBER 02, 2023 Considering the limited prayer made in the writ petition, which is for consideration of the petitioners' applications seeking regularization of plot Nos.59, 25, 23, 17A and 22 of Khasra Nos. 51/1 and 51/2 of Mouza Babulkheda, Nagpur, we have heard the learned Counsel for the parties.
2) Our attention is invited to the Resolution dated 27/7/2011 passed by the Nagpur Municipal Corporation as well as note-sheet appended thereto. We have also perused the Resolution dated 28/7/2022 passed by the Trustees of the Nagpur Improvement Trust that prescribes the modalities with regard to considering the prayer for exclusion of reservation and grant of regularisation with regard to Khasra Nos.51/1 and 51/2.
0211WP4134.23 2/2 3) In the light of aforesaid and by following the course adopted in Writ Petition No.5636/2016 (Shri Sanjay s/o Balkrushnarao Mule and others vs. Nagpur Improvement Trust and another), it is directed that the Nagpur Improvement Trust shall consider the applications of the petitioners for regularisation of the said plots from Khasra Nos.51/1 and 51/2 under the provisions of the Maharashtra Gunthewari Developments (Regularization, Upgradation and Control) Act, 2001. The necessary exercise be completed within eight weeks from today. The writ petition is disposed of.
