By this writ petition, the petitioner has challenged the tender notice, dated 29.06.2016, published by the Nagpur Municipal Corporation. The petitioner has sought a direction against the Corporation to finalize the tender submitted by the petitioner and the respondent No.3, that was opened on 28.06.2016. Shri J.B.Kasat, the learned counsel for the respondentCorporation, states on instructions that the cause for filing the writ petition has been rendered infructuous, as the process initiated in pursuance of the tender notice, dated 29.06.2016 stands cancelled, as responsive bids were not received, in pursuance of the said tender. It is stated that the second prayer of the petitioner also stands granted, as the Corporation has called the petitioner and the respondent No.3 for negotiations, in pursuance of the first tender notice and appropriate decision would be taken, after negotiating with the petitioner and the respondent No.3.

2/3 In view of the statements made on behalf of the respondentNagpur Municipal Corporation, we find that the grievance of the petitioner, as made in this writ petition, would not survive. Hence, by accepting the statements made on behalf of the respondent-Corporation, we dispose of the writ petition with no order as to costs.
