Heard the learned Counsel for the applicant and the learned A.P.P. for the State.

It is seen from the reply of the prosecution as well as the case-diary that this applicant has been sought to be impleaded in this crime only because the other co-accused are saying that the illicit liquor was procured by them from this applicant. However, there appears to be no independent material to prima facie support this allegation. The learned A.P.P. also could not show to me the presence of any such material on record of the case. Therefore, the criminal antecedents of this applicant would not serve as impediments for him to seek discretionary relief of anticipatory bail from this Court and, therefore, I am of the view that this application deserves to be granted.

The application is allowed. The interim anticipatory bail granted to the applicant by this Court on 5th July, 2016 is hereby confirmed on the same conditions.
