and Registrar's orders Mr. A.S. Dhore, Advocate for Petitioner.
Mrs. M.H. Deshmukh, AGP for Respondent Nos. 2 and 3. CORAM : B.R. Gavai & Indira K. Jain, JJ.
DATED : July 24, 2015.
The petitioner has approached this Court contending therein that the petitioner though applied from Woman (General) Reserved Category, it has been shown erroneously in the General Category.
Taking into consideration the nature of the allegations, we had requested the learned Additional Government Pleader to get the photostat copy of the original form submitted by the petitioner. The perusal of the form would reveal that the petitioner had in fact applied from General Category and as such was rightly shown in the General Category. It is thus clear that the petitioner has made an attempt to mislead this Court by placing on record a document which is not true to the knowledge of the petitioner.
In that view of the matter, the petition is dismissed subject to payment of costs which are quantified at Rs.25,000/- (Rs. Twenty Five Thousand). The petitioner shall deposit the costs before respondent No.4 i.e. Returning Officer. Respondent no.4 on receipt
WP4164-15.odt of the said costs shall deposit the same with the Taluka Legal Aid Committee, Zari-Jamni. It is made clear that in case the petitioner does not deposit the said costs, respondent No.3 shall recover the same as arrears of the land revenue and deposit the same with the Taluka Legal Aid Committee, Zari-Jamni.
