Heard.
The applicants are in custody since 5.2.2018 in connection with Crime 5 of 2017 registered at Vasant Nagar, Police Station, Pusad for offence punishable under section 302, 201 read with section 34 of the Indian Penal Code.
The case of the prosecution appears to be that the deceased Dhamma @ Ashish Pandit Dhepe was the husband of co-accused Chanda who was in an illicit relationship with one Subhash Pawar. The body of Dhamma was found in Nimbi village in burnt condition on 6.1.2017. The present applicants have been arrested after more than a year and the material against them appears to be suspicion voiced by the relatives of the deceased. The learned APP Shri S.S. Doifode states, in all fairness that the only material against the present applicants is the suspicion voiced by the mother, sister and brother of the deceased which is to the effect that Dhamma was
ba591of18.odt 2 murdered by Chanda, Subhash Pawar and the present applicants who are the brothers of Chanda.
At least at this stage, I do not find any material, other than the suspicion expressed by the relatives of the deceased to connect the applicants with the alleged crime. The application is allowed.
The applicants shall be released on furnishing personal bond of Rs. 15,000/- each with a solvent surety of like amount.
The applicants shall cooperate with the Investigating Officer.
The applicants shall not tamper with the evidence nor shall attempt to influence the witnesses in any manner.
