In the present appeal, judgment and order dated 23/04/2008 passed by the learned District Judge-2, Buldhana in G. & W. Case No. 4/2006 is under challenge.

At the time of filing of petition under Section 25 of the Guardians and Wards Act before learned District Judge, Buldhana, the son of appellant i.e. respondent no. 2 was 7 years old i.e. in the year 2006. In view of that, now his age must be of 23 years old. Therefore, there is no question of handing over the custody of respondent no. 2. As such, the matter has become infructuous. 3.
