DATED : 15/12/2020 By this writ petition, the petitioner has challenged interim order dated 19/12/2019, passed by the respondent No.1, whereby the petitioner has been restrained from functioning as Vice President of the Municipal Council. The impugned order is dated 19/12/2019 and it is in operation now for about one year.

At the outset, the learned counsel for the petitioner submitted that if this Court considered the alternative prayer made at prayer clause (4) then the respondent No.1 could be directed to dispose of the proceeding initiated by respondent No.6 expeditiously and if possible within 04 weeks.

The respondent No.1 is represented by the learned Additional Government Pleader, while the contesting respondent No.6 has appeared through counsel on caveat. It is submitted by learned counsel for the respondent No.6, that appropriate order could be passed by this Court on aforesaid prayer clause (4) in the writ petition.

In view of the above, the writ petition is disposed of with a direction to respondent No.1 to finally dispose of the proceeding initiated by the respondent No.6 under Section 51-A(5) of the Maharashtra Municipal Councils Nagar Panchayats and Industrial Townships Act, 1965, within a period of 08 weeks from today.
