The learned counsel for the petitioners states that despite the fact that vide impugned order 03/06/2022 the Sub-Divisional Officer directed the NaibTahsildar to make re-inquiry and pass order afresh, till date, neither fresh inquiry is conducted by the NaibTahsildar nor fresh order is passed. 2.

It is submitted that because of such approach of the Naib-Tahsildar, the petitioner has caused a great prejudice in the present matter. He, therefore, submits that if the Naib-Tahsildar is directed to decide the matter, after making fresh inquiry within stipulated period, the grievance of the petitioner would be resolved. 3.

The prayer of the petitioner is innocuous and can be considered by directing the Naib-Tahsildar to decide the matter within stipulated period. Accordingly, I pass the following order:

2 55-wp4218-2022 i) The writ petition is disposed of.

ii) The respondent-Naib-Tahsildar, Hinganghat is directed to act upon the impugned order dated 03/06/2022, passed by the Sub-Divisional Officer, Hinganghat and decide the matter within two months from today, after making fresh inquiry, as directed by the Sub-Divisional Officer.

iii) The parties shall appear before the NaibTahsildar, Hinganghat on 30/06/2023. iv) The learned A.G.P. undertakes to inform the order to the Naib-Tahsildar within one week and file pursis to that effect within two weeks. The writ petition is disposed of accordingly. No order as to costs.
