The applicant is seeking bail in Crime No.229 of 2021, registered with Police Station Pathrot, District: Amravati, for the offences punishable under Sections 376(2)(f), 315 and 318 of the Indian Penal Code and Sections 4 and 21 of the Protection of Children from Sexual Offences Act (hereinafter referred to as "POCSO Act"). 3.
The prosecution story is that, the victim is a minor and the accused No.1 repeatedly committed sexual intercourse with the victim. On revealing that the victim was pregnant, she was taken to Pathrot where she delivered a dead baby. It is alleged that the applicant and accused No.3 disposed of the body of the dead baby, without reporting the matter to the Police.

The applicant is the mother of the victim and considering the role of the applicant and the period of incarceration i.e. more than one year, I am of the opinion that, as the charge-sheet is filed and the investigation is completed, the applicant is entitled for grant of bail. Accordingly, I pass the following order:
a) The criminal application is allowed.
b) It is directed that the applicant shall be released on bail in Crime No.229 of 2021, registered with Police Station Pathrot, District: Amravati, for the offences punishable under Sections 376(2)(f), 315 and 318 of the Indian Penal Code and Sections 4 and 21 of the POCSO Act, on furnishing P.R. Bond of Rs.25,000/- with one solvent surety in the like amount.
c) The applicant shall attend the concerned Police Station as and when her presence is required. The criminal application is disposed of accordingly.
