This is a second attempt on the part of the applicant to get himself released on bail.

Heard Shri R.M. Patwardhan, learned counsel for the applicant and Ms. T.H. Udeshi, learned Additional Public Prosecutor for the non-applicant / State and also perused the charge-sheet.

The learned counsel for the applicant fairly states that there is no change in circumstance after his first bail application was rejected by this Court (Coram : V.M. Deshpande, J.) on 03/02/2020. He further submits that as on today there is no progress in the trial. 4.

Speedy trial is the right of the accused, who is languishing in jail. In my view, since there is no change in circumstance, the bail application cannot be

18-ba-1020-2021.odt considered. The learned counsel for the applicant submitted that direction be given to the learned Trial Court for expeditious disposal. In my view, the same can be done in the interest of justice. Hence, I pass the following order.

ORDER

i.

The application is disposed of as withdrawn.

ii.

The learned Adhoc Additional District Judge-1, Wardha, before whom Special Case No.12/2019 is pending shall decide the same as expeditiously as possible and within a period of one year from the receipt of the order.
