DATED : 06-10-2021 At the very outset, the learned counsel for the applicant invites my attention to the order of this Court dated 22-2-2021 in Criminal Bail Application 75 of 2021 which reads thus :

"Heard. The allegations against the Applicant are that he committed rape on a minor girl.

Mr. Raja Sekhar, the learned Counsel appearing for the Applicant submits that now the trial has commenced, therefore, he wants to withdraw the present Application. Permission granted.

Criminal Application stands disposed of, as withdrawn."

It is submitted that although the charge is framed on 5-12-2020, the evidence has not commenced.

The learned counsel for the applicant submits that the trial Court may be directed to expedite the trial and such is, even otherwise, the mandate of the Protection of Children from Sexual Offences Act.

The submission is reasonable.

The learned trial Court is requested to commence the trial as soon as possible and to conclude the same within the next nine months.

If there is no progress in the trial in the coming ninety days, the applicant shall be at liberty to apply for bail afresh before this Court, provided this order is brought to the notice of the trial Court by the applicant within next seven days, and further provided that the accused is not responsible for the delay.

The application is disposed of.

The fees of learned counsel Mr. Ganesh Umale appointed for the victim be quantified and paid as per the Rules.
