DATED : OCTOBER 7, 2021 This matter was listed before this Court on 23.09.2021. On the said day, Mr. Madne, learned counsel for applicants, made a statement before this Court and which was recorded in the order dated 23.09.2021 that though charge-sheet is filed, due to intervention of elderly persons, matter is compromised between the parties. Therefore, we issued notice and also asked complainant to remain personally present to verify the factum of compromise or otherwise.
Accordingly, today Mr. Ashok s/o Deorao Ahire is personally present. He is represented by Mr. Paliwal, Advocate. On being asked about the compromise, the complainat-Ashok submitted to the Court that at no point of time, there was compromise between the parties.
apl976.21.odt Mr. Madne, learned counsel submits that he made a statement on the earlier occasion as per the instructions given to him. Mr. Madne should be very cautious next time and shall not make such statements. Mr. Madne, learned counsel for the applicants, after arguing the matter, submits that he be permitted to withdraw the application so as to enable the applicant to file appropriate application before the Special Court. The statement is accepted.
The application is disposed of as withdrawn.
