The contention is, on instructions of the Minister, the petitioner has been transferred and it is premature. 2.

The A.G.P. submits that the Maharashtra Administrative Tribunal has looked into contingency. The petitioner has been sent from one office to another office in Yavatmal city and distance between two offices is about 27 meters. He also points out that malafides cannot be examined in this matter.

With the assistance of the parties, we have perused the papers. We find that though word "transfer" has been employed, the petitioner has been shifted from one office to other within city and the distance between two officers is very short. The petitioner has no right to a particular office or a particular table. Not only this, if allegations of malafides are to be examined, the Hon'ble Minister should have been joined as party respondent, that also not been done.

We are, therefore, not inclined to exercise the writ jurisdiction. The petition is rejected. No costs. (Z.A.Haq, J) (B.P.Dharmadhikari,J) RRaut..
