Date : 27 th November, 2015 The judgment and order passed by the Reference Court under Section 18 of the Land Acquisition Act, 1894 is the subject-matter of challenge in both these appeals claiming further enhancement of compensation. The Reference Court has awarded the compensation at the rate of Rs.37,500/- per hectare. First Appeal No.631 of 2003 preferred by the State Government challenging enhancement granted by the Reference Court has been dismissed by this Court on 26-11-2015. Similarly, First Appeals No.7 of 2004, 86 of 2004, 104 of 2004, 381 of 2007 and 392 of 2007 decided by the common judgment and order dated 25-11-2009 (Shri A.B. Chaudhari, J.) also confirms the compensation at the rate of Rs.37,500/- per hectare.
2711fa42.03+.odt In spite of the fact that the matter was listed and called out on 26-11-2015 and today also, none appears for the appellant-claimants.
Both these appeals are dismissed for want of prosecution. The common judgment and order dated 25-11-2009 passed in First Appeals Nos.7 of 2004, 86 of 2004, 104 of 2004 and 381 of 2007; and the judgment and order dated 26-11-2015 passed in First Appeal No.631 of 2003, referred to above, be placed on record of both these appeals for perusal.
