DATE : October 18, 2016 The challenge in the present writ petition is to the impugned order passed by the Industrial Court dated 04/07/2015 on the application seeking interim relief of staying the order of transfer dated 30/05/2015. By the impugned order this application came to be rejected. On 22/07/2015 while issuing notice, this Court rejected the prayer for grant of interim relief.

Shri S. N. Gaikwad, the learned counsel for the petitioner submits that the petitioner has since joined the place of transfer. He submits that the complaint is still pending before the Industrial Court.

Shri M. A. Sable, the learned counsel for the respondents does not dispute the fact that the petitioner has joined at the place of transfer.

In view of aforesaid, it is not necessary to examine the correctness of the impugned order dated

25-WP-4163-15 2/2 04/07/2015. However, in the facts of the case the proceedings in Complaint (ULP) No.53/2015 are expedited. The Industrial Court shall decide the complaint on its own merits uninfluenced by the present order by the end of March 2017.

Writ petition is disposed of in aforesaid terms with no order of costs.
