In view of developments disclosed in the affidavit of the State Government filed on 11.2.2015, Mr.A.R.Patil, learned Counsel for the petitioner seeks leave to withdraw the Writ Petition with liberty to file afresh raising all necessary challenges.

Mr.N.S.Khubalkar, learned A.G.P. for respondent nos. 1 to 5 is opposing grant of any liberty. However, as the Society is registered subsequently and tank is also allotted, we grant the request made by Mr.A.R.Patil, learned Counsel for the petitioner. The Writ Petition is accordingly allowed to be withdrawn with liberty, as prayed for.
