1] The learned counsel Shri Mirza states that pursuant to the order dated 20.06.2018 the applicant has attended Police Station Hiwarkhed and has co-operated with the investigating officer. The learned A.P.P. Jawade does not controvert this statement.
2] The material on record would show that there were cross reports lodged by the warring parties. The applicant is also suffered injuries, is the submission of the learned counsel Shri Mirza. This submission is also not disputed although according to Shri Jawade it was the applicant along with the other co-accused who first assaulted Idris Khan and it was only thereafter that the other group retaliated and injured the present applicant. 3] It does not appear that the custodial interrogation of the applicant is necessary. In view of the circumstances of the incident and the fact that it is not very
aba420.18.O.odt 2 clear as to who started the altercation, I am inclined to confirm the interim order.
4] The interim order dated 20.06.2018 is confirmed with the modification that the applicant shall attend Police Station Hiwarkhed as and when called upon to do so by the investigating officer.
