Heard.

This Court was not inclined to consider the application at this stage since the investigation is at a nascent stage and the co-accused are allegedly absconding. The learned counsel for the applicant seeks leave to withdraw the application unconditionally.

However, the submission is that the applicant is not keeping well, he has already suffered a paralysis attack and has cardiac issues.

The State is directed to refer the applicant to the Government Medical College and Hospital, Nagpur within 48 hours and the Dean, Government Medical College, Nagpur is directed to submit a report to the Superintendent of Jail within the next 48 hours. Needless to say a copy of the said report shall be made available to the applicant. After receipt of the said report, the applicant is at liberty to apply for bail on medical grounds. The said application shall be considered by the learned Sessions
