Rule. Rule made returnable forthwith. Heard finally by consent of the learned counsel for the respective parties. 3.
Mr. Patil, learned counsel for the petitioner, produced before this Court a decision passed by this Court in Writ Petition No. 2257/2021 decided on 17/01/2022 (Vijay Sukhdevrao Nishane Vs. State of Maharashtra & Ors.) wherein in the light of the Government Resolution dated 29/10/2021, the Lecturers who have not cleared NET/ SET and who are appointed between 23/10/1992 to 03/04/2000 are held entitled to get pension. The learned counsel submits that the case of the petitioner herein is covered with the decision in the said Writ Petition.

Ms. Jaipurkar, learned A.G.P. for respondent Nos. 1 and 2, and Mr. Bhuibhar, learned counsel for respondent No.3, do not dispute the aforesaid position.

Given the fact that the petitioner herein was appointed as Librarian with respondent No. 3 on 01/10/1996, he is entitled to get benefit as per the Government Resolution dated 29/10/2021.

In this view of the matter, the pension to the petitioner be released accordingly within a period of four weeks. The arrears of the pension shall be released to the petitioner in two equal installments within a period of six months.
