Heard the learned Counsel for the appellant, the learned Counsel for respondent no.1 and the learned A.P.P. for respondent no.2/State.

On going through the impugned judgment and order and the evidence available on record, prima facie, I find that inconsistency and discrepancy in the prosecution witnesses forming the basis of acquittal of the accused, in many ways, cannot be seen. This is a fit case for grant of leave to file appeal and also admitting the appeal. Leave to file appeal is granted. The application is allowed and disposed of.
