CRIMINAL APPLICATION (APPA) 544/2021 1.

This is an application seeking suspension of execution of sentence.

The Trial Court has convicted applicant

(accused) for the offence punishable under Sections 353, 294 and 506 of the Indian Penal Code. The maximum sentence awarded is to undergo rigorous imprisonment for three months. During trial, the applicant was on bail and after conviction, the Trial Court has suspended the execution of sentence. The fine amount is already deposited. The appeal will take its own time for hearing.

In view of above, the execution of substantive sentence passed by the Trial Court in Sessions Case No. 416/2019 is hereby suspended till disposal of appeal. In the meantime, the appellant be released on bail on the same terms and conditions as imposed by the Trial Court while suspending sentence.
