By this application, the applicant is seeking transfer of the matrimonial proceedings bearing A-Petition No.83/2022 pending before the learned Principal Judge, Family Court, Amravati.

Learned Counsel for the applicant submitted that applicant has filed an application under Section 125 of the Code of Criminal Procedure for maintenance and non-applicant has preferred an application under Section 9 for Restitution of Conjugal Rights. Learned Counsel for the applicant attempted to communicate with the applicant, but the applicant is not in contact with her and on verifying the status, it reveals to her that the application filed by the applicant - wife for maintenance is dismissed and application under Section 9 of the Hindu Marriage Act for Restitution of Conjugal Rights filed by the non-applicant is dismissed for default. Thus, the application became infructuous.
