Civil Application (O) No.795/2017:

This is an application for restoration of Civil Application (F) No.3390/2016, which was dismissed for default for non removal of office objection. Office objection was to pay the deficit Court fee, and therefore, issue notice to the legal heirs of deceased-respondent No.2. Now, learned counsel Shri Narwade appears for the legal heirs of deceased-respondent No.2 and he has no objection to restore the application bearing Civil Application (F) No.3390/2016. Accordingly, this application is allowed in the interest of justice and Civil Application (F) No.3390/2016 is restored to his original file. On the request of the learned counsel for appellant time of one week is granted for removal of office objection.
