Petitioner whose son is in sand business according to respondents, has filed present proceedings to demonstrate huge loss allegedly sustained by revenue in auction of sand ghat in the year 2014-15.

Inference of loss is drawn only from the fact that one Subhash Khilwani during e-auction proceedings had offered an amount of

Order 0507pil27.15 Rs.3,43,01,100/-. It is pointed out that, that offer was not accepted and sand ghat has been allotted to other person who offered amount of Rs.34,05,101/-.

Respondent State has filed reply-affidavit.

Apart from doubting the bonafides of petitioner, they have also explained that upset price for that sand ghat was only Rs. 11,98,500/- and Subhash Khilwani committed an error while feeding data during eauction. We therefore, find material on record insufficient to hold that any loss is sustained by public revenue. Accordingly, Public Interest Litigation is disposed of. No costs.
