In anticipation of arrest in connection with Crime No.419/2021 registered with the Non-applicant - Gadchiroli Police Station, District Gadchiroli for the offence punishable under Sections 65[e] and 98 of the Maharashtra Prohibition Act, 1949, the applicant is seeking pre-arrest protection.

It is the prosecution case that on secret information, the police had caught hold the accused and seized 10 liters of mauha liquor worth Rs.2000/- from his possession, however, he ran away.

The State has filed reply in the matter. It is
Order 2909aba623.21 their contention that the applicant has attended police station and cooperated with the investigation. It is also stated that investigation is over and there are no antecedents against the applicant. In view of that applicants liberty can be protected, hence, the following order.
(i) Criminal Application is allowed and disposed of.
(ii) In the event of arrest of the applicant/accused - Vaibhav Vasant Surjagade in connection with Crime No.419/2021 registered with the Nonapplicant - Gadchiroli Police Station, District Gadchiroli for the offence punishable under Sections 65[e] and 98 of the Maharashtra Prohibition Act, 1949, he be released on bail, on his furnishing P.R. Bond in the sum of Rs.25,000/- with one surety in the like amount.
(iii) The applicant/accused to attend the concerned police station as and when called for.
(iv) The applicant/accused shall not tamper with the prosecution evidence in any manner.
