The Full Bench judgment of this Court in the case of Arun Vishwanath Sonone vs. State of Maharashtra & Ors., 2015 (1) Mh.L.J. 457 (FB), is overruled by the Hon'ble Apex Court by judgment in the case of Chairman-cum- Managing Director, Food Corporation of India & Ors. vs. Jagdish Balaram Bahira & Ors., reported at 2017 (7) Scale 395. As such, the claim for protection being pressed in the matter is misconceived.

Hence, with liberty to the petitioner to take such other steps as may be open in law, we dispose of the present writ petition. No costs.
