Heard.
After hearing the learned counsel Shri M.N. Ali and Shri N.B. Jawade, the learned APP for some time and after perusing the material on record, this Court was not inclined, at least at this stage, to consider the application for bail.
The learned counsel Shri M.N. Ali seeks leave to withdraw the application, however, the submission is that the applicant be permitted to apply afresh if there is no significant development or progress in the trial. The applicant is always at liberty to apply for bail if the trial is unduly prolonged.
It is left to the discretion and wisdom of the learned trial Court to determine whether there is any undue delay in conducting the trial.
With these observations, the application is disposed of.
