Shri Kapgate, learned counsel for the applicant/ petitioner, Mrs. Deshpande, learned AGP for respondent No. 1 and Shri Deshmukh, learned counsel for respondent No.2. The learned counsel for respondent No. 2 and the learned AGP seek time of one week.

In the petition, the petitioner seeks to challenge the constitutionality of certain provisions of the Maharashtra Water Conservation Corporation Act, 2000. By amendment, the part of challenge insofar as it affects Respondent No. 3 is sought to be given up. Consequently, prayer clauses (iii) and (v) are sought to be deleted. In this situation, without prejudice to the rights and contentions of the respondents and at the risk of the petitioner, we grant Civil Application No. 1516 of 2015. The necessary amendment be carried out within one week. List the matter for admission thereafter.
