By this writ petition, the petitioners have challenged an order passed by the Sub-Divisional Officer (SDO) rejecting the application for stay pending the appeal before the said authority.

02] The appeal before the SDO has arisen out of the order of the Naib-Tahsildar, whereby the right of way is granted to the contesting respondents through the field of the petitioners.

03] On 21/09/2021, this Court granted stay to the order of the Naib-Tahsildar, which has continued to operate till date. The appeal pending before the SDO is now ready for final hearing.

04] In view of the above, this writ petition is disposed of by directing that the interim stay granted by this Court on 21/09/2021, shall continue to operate till the appeal filed by the petitioners is finally decided by the SDO.

3.wp.3637.21 2/2 05] The SDO is directed to decide the appeal expeditiously. The parties shall appear before the SDO on 13th April, 2022. The SDO shall finally decide the appeal within four weeks from 13/04/2022.
