This writ petition was directed to be heard along with Writ Petition No.3802/2009. Said Writ Petition No.3802/2009 (Nagpur Distillers Private Limited and others vs. City of Nagpur Municipal Corporation and another) came to be decided on 16/12/2022 and the challenge as raised to the City of Nagpur Corporation Assessment and Collection of Water Rate Bye-laws of 2009 as been ultra virus was not accepted. The said writ petition consequently came to be dismissed. 2.

The learned counsel for the petitioner fairly submits that since an identical challenge has been raised in the present writ petition which has been considered and decided in the earlier writ petition, it would not be appropriate to re-argue the same points in the present writ petition.
