A show cause notice dated 15.6.2022, issued to petitioner No.1 by respondent No. 2, is the subject matter of challenge in this petition. This Court, vide order dated 25.7.2022, directed the authorities to continue with the enquiry but not to take final decision. 3.

In an affidavit filed on 19.10.2022, in paragraph 9, the respondent No. 2 made following statement.

"9. The action initiated by the Licensing Authority is totally legal and as per the provisions contemplated in FCO 1985. Inquiry report of the enquiry officer about the purchase of raw material, production, sale and stock in hand has been received and the report says that there is no mismatch found in actual and IFMS purchase quantity".

In view of the statement in the affidavit, learned counsel for petitioners does not want to press present petition, however, seeks liberty to approach this Court if such occasion arises. 4.

In view of above statement, permission is granted to withdraw the petition. Petition is disposed of with liberty as prayed. Belkhede, PS

2 947wp4235.2022..doc It is further directed that if any adverse order is passed after disposal of this petition against the petitioner, in light of the show cause notice impugned and the enquiry conducted in relation with such show cause notice, such order shall not be given effect for 15 days from the date of communication of the same to the petitioners.
