The matter is listed in order matters with office note that the report of notice issued to non-applicant / respondent Nos.1 and 2 is awaited. 2.

The noting of this criminal application shows that the matter is dismissed against the non-applicant / respondent Nos.3 and 4 as per the Court's order dated 18th October, 2013. There is nothing on record to show that the applicant / appellant has taken any steps to get the matter, dismissed against non-applicant / respondent Nos.3 and 4, restored.

The complaint filed by the applicant under Section 138 of the Negotiable Instruments Act, 1881 was dismissed on 16th September, 2011 as the complainant and accused were absent when the matter was called out. The accused were acquitted under Section 256 of the Code of Criminal Procedure.

This matter is pending before this Court since

None appeared for the applicant / appellant on 14th November, 2014. After 14th November, 2014 the matter is listed today. Again neither applicant nor it's Advocate is present when the matter is called out. 6.
