DATED : 01 AUGUST, 2016 01 AUGUST, 2016 Heard learned Counsel for the applicant and learned A.P.P. for the State. Perused the charge-sheet. It is seen from the charge-sheet that this applicant is neither the president, nor director, nor member of the credit society nor is he the employee of the credit society in question. It is also seen that his signature did not appear anywhere. The allegations of cheating and embezzlement are made against the society. The manager and few employees of the society and some of the directors of the society, who are co-accused, have been granted anticipatory bail. The president of the society and the remaining directors, who are also co-accused, have been granted regular bail. Thus, out of 19 accused persons, 18 accused persons have already been granted bail, whether regular or anticipatory. This
applicant, who is neither president nor a director nor an employee of the society nor whose signature appears anywhere on the documents, however, has not been granted bail. The reason perhaps is some allegations of illegal interference made by him in the past in the affairs of the society. I do not think that in such circumstances, this applicant could be denied relief of the bail. Hence, the order.
The application is allowed and it is directed that this applicant be released on bail on his furnishing a P. R. Bond in the sum of Rs.25,000/- together with one solvent surety in the like amount on the conditions that the applicant shall attend the Court regularly on the dates fixed in the matter, shall cooperate the Court in expeditious disposal of the case and shall not tamper with the prosecution witnesses.
