DATE : 11/07/2025 Learned counsel for the petitioner fairly agrees to deposit an amount of Rs.50,000/- (Rupees Fifty Thousand Only) for lapses on part of petitioner those are recorded by the learned 10th Joint Civil Judge (Senior Division), Nagpur while rejecting request. Equally this Court while issuing notice in its order dated 31.08.2021 has recorded same. 2.
Learned counsel for respondent No.1 objected same considering the conduct of the petitioner. Considering the fact that the petitioner has agreed to deposit the aforesaid amount and the interest of justice would sub-serve by allowing the petitioner to deposit the amount considering the nature of challenge raised in the suit. Counsel for the petitioner undertakes to deposit the said amount within two weeks from today.

Time is granted.

The amount shall be deposited in the trial Court within the period of two weeks and upon such deposit the plaintiff is permitted to withdraw the said amount.

On such condition of deposit, the application is allowed. If amount as aforesaid is not deposited within the aforesaid period, the order dated 20.06.2017 passed by 3rd Joint Civil Judge, Senior Division, Nagpur in Sp. C.S. No.543/2014 shall stand restored.

Since the suit of 2015, concerned Court is requested to expedite the same and in any case within a period of 8 months from the date of receipt of this order. No costs.
