Heard Shri M.V. Bute, learned Counsel for the petitioner and Shri D.P. Thakare, learned Addl.G.P. for respondent no.2.

Short submission of learned counsel for the petitioner is, in view of Constitution, Scheduled Tribes (Amendment) Order, 1976 the Scrutiny Committee could not have insisted for a document prior to 1950. He states that all documents before 1976 and after 1950, should have been accepted as decisive.

submits that Constitution Scheduled Tribes Order, 1950 contained

Order 2606wp3555.18 area restriction, which has been done away by 1976 Amendment, hence relevant date does not undergo any change.

We find substance in contention of learned Addl.G.P. who appears for respondent no.2 Committee. 1976 Amendment only removes area restriction. Hence, the challenge is misconceived. Writ Petition is, therefore, rejected. No costs. JUDGE JUDGE Rgd.
