Heard the learned counsel for the petitioner as well as the learned Assistant Government Pleader for the respondents/State.

The present petition is an exception to the order dated 25.03.2019, passed by the learned Deputy Commissioner (Supply), Nagpur Division, Nagpur, whereby the Deputy Commissioner (Supply) remanded the matter to the District Supply Officer.

Learned Assistant Government Pleader points out that, as per the order passed by the learned Deputy Commissioner (Supply), the petitioner has an alternate and equally efficacious remedy by filing a revision under Clause 24 of the Maharashtra Scheduled Commodities (Regulation of Distribution) Order, 1975.

In view thereof, as the petitioner is having an alternate and equally efficacious remedy, the petition is disposed of as not maintainable.

The petitioner is at liberty to file a revision before the State Government within a period of four weeks from today. Delay caused while prosecuting the present petition shall be taken into consideration by the appellate authority, while considering the application for condonation of delay. No order as to costs.

It is pointed out that an interim relief granted by this Court vide order dated 04.07.2019 is in operation till date in the present petition. In view of this fact, interim relief shall continue until the State Government decides the matter on its own merits.
