Present application is filed for issuance of directions to release the amount in favour of respondent Nos.1 and 3 since respondent No.2 is dead.

Learned Advocate for appellant submitted that now the amount is already deposited and he is withdrawing the said application.

The civil application is disposed of as withdrawn. CIVIL APPLICATION (F) NO.1600 OF 2021.

Present application is filed by the applicant Vimal Anandrao Mandavkar to release the share of compensation of respondent No.2 in her favour being she is daughter of late Smt Saibai Shrawan Dambhare.

Learned Advocate for respondent Nos.1 and 3 has no objection for the same.

In view of the above, applicant Vimal Anandrao Mandavkar is permitted to withdraw the share of late Smt Saibai TAMBE

18 CAF-1966-2022 Shrawan Dambhare being the daughter on the basis of will executed by respondent No.2 in her favour.

The respective shares of respondent Nos.1 and 3 be disbursed alongwith accrued interest to the respondent Nos.1 and 3 on due identification and verification. The share of respondent No.2 be disbursed to her daughter who is legal heir alongwith accrued interest on due identification and verification. 8.

In view of the above, the civil application is allowed and disposed of accordingly.
