01] By this application, the Applicant has sought restoration of the appeal, which was dismissed on 27.08.2021 for non-filing of paper-book.

02] The Appellant has not raised any statutory defence. Hence, notice to the Respondent No.3 is dispensed with. 03] Learned counsel for the Appellant states that the paper-book will be filed within two weeks. In the light of the said statement and in view of the reasons stated in the application, the application is allowed. The appeal is ordered to be restored to file. Civil application stands disposed of.
