Heard Shri Tarun Parmar, learned Counsel (appointed) for the petitioner and Ms. M.H. Deshmukh, learned A.P.P. for respondents.

Challenge is to show cause notice dated 14.01.2016, proposing punishment of cancellation of remission of one day for each one day of absence/late reporting. Petitioner has reported late by 15 days. 3.

Learned A.P.P. is relying upon reply affidavit and states that during the pendency of this challenge, order of punishment is already issued on 25.01.2016.

In this situation, without observing

anything on the merits of the controversy and with liberty to petitioner to challenge that order of punishment, we dispose of present petition.

Fees payable to the learned counsel (appointed) for the petitioner is quantified at Rs.1500/-.

Writ Petition has been unnecessarily filed challenging show cause notice, hence, 50% of the charges payable to the learned Counsel (appointed) for the petitioner by the legal aid, be recovered from Prisoner, through Jail Superintendent's Office. JUDGE JUDGE Rgd.
