CORAM

: S.B. SHUKRE, J.

DATE : 26 th AUGUST, 2016.

Heard the learned Counsel for the applicant and the learned A.P.P. for the State.

The learned Counsel for the applicant submits that the main accused viz. Shankar Margoni has been released on bail by this Court and the case of the applicant stands on better footing as the allegations against him are that on some occasions he was seen in the company of Shankar Margoni, when the latter tried to induce the victims and that two seals have been recovered at his instance.

The learned A.P.P. for the State submits that though Shankar Margoni has been released on bail by this Court on 19/07/2016, he would oppose the application on the ground that the allegations against the accused are serious in nature.

Having regard to the role attributed to this applicant, I am of the view that the case of the present applicant is not distinguishable from the case of Shankar Margoni and so on the ground of parity, the present applicant is also entitled to be released on bail. Hence, the order: The application is allowed and it is directed that the applicant be released on bail on his furnishing a P.R. Bond in the sum of Rs.25,000/- together with one solvent surety in the like sum on the conditions that the applicant shall regularly attend the dates fixed by the Court, shall cooperate the trial Court in expeditious disposal of the case against him and shall not tamper with the prosecution witnesses in any manner.

The application is disposed of in the aforesaid terms.
