The applicant is arrested on 23rd April, 2016 in connection with crime registered against him for the offence punishable under Section 302 of the Indian Penal Code on the accusations that the applicant has killed his wife by giving blow of wooden stick on vital parts of her body. The application is opposed on the ground that minor daughters of the applicant have witnessed the incident and it is reported by daughter of the applicant. The applicant, aged about 39 years, claims to be a cultivator and has stated that he is not involved in any other crime/ offence. It is submitted on behalf of the applicant that minor daughters of the applicant are residing with their maternal uncle (brother of wife of the applicant). The chargesheet is field on 19th July, 2016. The non-applicant has not been able to point out that the custody of the applicant is required for further investigation.

2 ba583.17 Considering the facts of the case, following order is passed:

The applicant having been arrested in connection with Crime No.41/2016, registered by the non-applicant, he be released on bail on executing P.R. Bond for Rs.Fifty Thousand and furnishing two solvent sureties for Rs.Twenty Five Thousand each.

Till the trial concludes, the applicant shall not enter village Boda, Tahsil : Amgaon, District : Gondia and shall not meet or attempt to meet his daughters without prior permission of the Sessions Court.
